ANALISIS PERAN DAN FUNGSI BADAN PENGAWAS PEMILIHAN UMUM DALAM PENCEGAHAN PELANGGARAN PILKADA TAHUN 2024

Abstrak

Pemilihan Umum (Pemilu) Di Negara Republiik Indonesia memegang peranan peting dalam berfungsinya demokrasi, hal  ini juga tidak terlepas dari peran Lembaga-lembaga yang dibentuk oleh negara untuk menyukseskan Pemilihan Umum, Adapun Lembaga yang didirkan oleh Negara Kesatuan Republik Indonesia, negara dalam rangka Pemilihan Umum yaitu Komisi Pemilihan Umum (KPU), Badan Pengawas Pemiliihan Umum (Bawaslu), dan Dewan Kehormatan Penyelanggara Pemilihan Umum (DKPP). Badan Pengawas Pemilihan Umum adalah lembaga penyelenggara pemilu yang independen dalam melaksanakan tugas dan wewenangnya. Pelaksanaan tugas dan kewenangan Bawaslu diatur dalam UU Nomor 7 Tahun 2017 tentang Pemilu. Bawaslu perlu memahami perannya yang penting dalam memastikan integritas pemilihan umum. Salah satu peran penting dari Badan Pengawas Pemilihan Umum adalah untuk mengawasi tahap-tahap dan mencegah terjadinya pelanggaran dalam pemilihan umum. Diharapkan peran serta fungsi Badan Pengawas Pemilihan Umum mampu menghindari pelanggaran dalam penyelenggaraan pesta demokrasi di Indonesia. Penyelenggaraan Pemilihan Umum (Pemilu) merupakan salah satu indikator untuk menilai seberapa demokratis sebuah negara. Melalui pemilu, akan tampak apakah sebuah negara mampu menjaga kedaulatan rakyat dan apakah negara melindungi hak-hak demokratis warganya, baik dalam pemenuhan hak asasi manusia, yang merupakan ciri negara hukum yang sejati.

General Elections (Pemilu) In the Republic of Indonesia play an important role in the functioning of democracy, this is also inseparable from the role of the institutions created by the state to make the General election a success, as for the institutions established by the Indonesian state in the context of the General Election, namely, the General Election Commission (KPU), the General Election Supervisory Body (Bawaslu) and the Honorary Council for General Election Organizers (DKPP). The relationship between these three institutions plays an important role in the running of the election stages, where the KPU is  the implementer of the election stages, Bawaslu is the supervisor of the election stages and the DKPP is the Institutions that assesses the ethichs and behavior of the KPUU and DKPP. The General Election Supervisory Body is an independent election managemenr institution regarding the implementation of its duties and authority. The implementation of Bawaslu duties and authority is regulated in Law Number 7 of 2017 concerning general elections. The Generald Election Supervisory Body (Bawaslu) must understand its important role in ensuring the integrity of general elections. One of main functions o the General Elections Supervisory Body is to supervise the stages and prevent general election violations. It id hoped that the role and fuction of the General Election Supervisory Body can prevent violations in the implementation of the democratic party in in Indonesia. The holding of general elections is one of the parameters in measuring whether a country is democratic ot not. Through elections, it will be seen whetger a country can maintain the sovereignty of the people, as well as whether the state guarantees the democratic rights of citizens, whether they are fulfilled in the context of protecting human rights, that is a true rule of law.
