PERLINDUNGAN HUKUM TERHADAP PENCIPTA ATAS PENGGUNAAN LATAR MUSIK KONTEN TANPA IZIN OLEH CONTENT CREATOR PADA APLIKASI TIKTOK

Abstrak

Perkembangan dunia konten saat ini begitu masif sehingga menyasar kepentingan komersial yang menguntungkan setiap pembuat konten, salah satunya melalui platform Tiktok yang merupakan platform berbasis website yang memuat berbagai macam unggahan video. Unggahan video ini bisa berisi berbagai hal, salah satunya tentang lagu. Artikel ini dimaksudkan untuk mengetahui dan memahami secara utuh penggunaan hak cipta lagu dari penciptanya tanpa izin untuk tujuan komersial. Penulis juga mengulas upaya-upaya yang dapat dilakukan negara agar karya cipta penciptanya tidak digunakan tanpa izin untuk tujuan komersial. Penggunaan karya berhak cipta tanpa izin pencipta untuk tujuan komersial merupakan suatu bentuk kejahatan di bidang kekayaan intelektual yang menimbulkan sanksi berdasarkan undang-undang hak cipta. Untuk melindungi pencipta lagu yang karyanya digunakan tanpa izin untuk tujuan komersial, perlu dilakukan penegakan hukum yang tegas melalui undang-undang hak cipta. Hal terakhir yang perlu dilakukan adalah pengawasan yang sangat ketat terhadap seluruh pusat perbelanjaan agar barang yang masuk dan dijual pada pusat perdagangan tersebut jauh dari barang hasil kejahatan hak cipta, karya lagu, atau barang bajakan.
