PERBANDINGAN LEMBAGA LEGISLATIF DALAM SISTEM PEMERINTAHAN PRESIDENSIAL DENGAN SITEM PEMERINTAHAN PARLEMENTER

Pembagian kekuasaan yang kita ketahui sekarang, yaitu Eksekutif, Legislatif dan Yudikatif. Akan tetapi, dalam penelitian ini memfokuskan bahasannya ke dalam Perbandingan lembaga legislatif dalam Sistem Pemerintahan Presidensial dengan Sistem Pemerintahan Parlementer yang sangat berbeda tergantung pada apakah suatu negara menggunakan sistem presidensial atau parlementer. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan yuridis normatif. Metode ini digunakan karena tujuan penelitian adalah untuk menganalisis hukum dan standar yang mengatur fungsi lembaga legislatif dalam dua sistem pemerintahan yang berbeda. Hasil dari penelitian ini ialah Perbandingan lembaga legislatif dalam Sistem Pemerintahan Presidensial dengan Sistem Pemerintahan Parlementer menunjukkan bahwa kedua sistem memiliki kelebihan dan kekurangan. Sistem presidensial menawarkan stabilitas dan mekanisme checks and balances yang kuat, namun rentan terhadap kebuntuan politik. Sebaliknya, sistem parlementer lebih fleksibel dan efisien dalam pembuatan undang-undang, tetapi menghadapi risiko ketidakstabilan dan konsentrasi kekuasaan. Dalam hal representasi rakyat, sistem presidensial memastikan pemisahan kekuasaan yang jelas, sementara sistem parlementer mengintegrasikan eksekutif dan legislatif untuk pemerintahan yang lebih responsif. Dengan memahami perbedaan-perbedaan ini, penulis berharap negara-negara dapat memilih atau menyesuaikan sistem pemerintahan yang paling sesuai dengan kebutuhan dan konteks politik, sosial, dan budaya mereka.
The division of powers that we know now, namely the Executive, Legislative and Judiciary. However, this research focuses on the comparison of legislative institutions in the Presidential Government System with the Parliamentary Government System which is very different depending on whether a country uses a presidential or parliamentary system. This research uses a qualitative research method with a normative juridical approach. This method is used because the purpose of the research is to analyse the laws and standards governing the functions of the legislature in two different systems of government. The result of this research is that the comparison of legislative institutions in the Presidential Government System with the Parliamentary Government System shows that both systems have advantages and disadvantages. The presidential system offers stability and a strong checks and balances mechanism, but is vulnerable to political deadlock. In contrast, the parliamentary system is more flexible and efficient in lawmaking, but faces the risk of instability and concentration of power. In terms of popular representation, presidential systems ensure a clear separation of powers, while parliamentary systems integrate the executive and legislature for more responsive governance. By understanding these differences, the author hopes that countries can choose or adapt a system of government that best suits their needs and political, social and cultural context.
