Abstrak

Perkembangan teknologi informasi telah mengubah lanskap pemasaran melalui pemanfaatan platform media sosial secara masif. Di balik efisiensi tersebut, maraknya praktik iklan digital yang memuat informasi tidak akurat, berlebihan, dan manipulatif menimbulkan ancaman serius bagi hak-hak konsumen digital. Penelitian ini bertujuan untuk mengkaji pengaturan hukum positif di Indonesia terhadap praktik iklan yang menyesatkan di media sosial serta menganalisis efektivitas sistem pengawasan dan mekanisme verifikasi konten iklan tersebut dalam memberikan perlindungan hukum bagi konsumen. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach) melalui analisis Putusan Nomor 002/A/BPSK-DKI/VIII/2025. Sumber bahan hukum dikumpulkan melalui studi kepustakaan (library research) yang dianalisis secara kualitatif.Hasil penelitian menunjukkan bahwa regulasi yang ada, seperti Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik (UU ITE), telah memberikan landasan normatif, termasuk peluang gugatan Perbuatan Melawan Hukum (Pasal 1365 KUH Perdata) atas kerugian pada fase pra-kontraktual. Namun, masih terdapat kekosongan hukum (rechtsvacuum) terkait parameter tegas strategi promosi kontemporer (seperti iklan terselubung dan kewajiban transparansi komersial). Sistem pengawasan saat ini juga dinilai belum efektif karena bersifat fragmentatif dan mengalami hambatan koordinasi ego-sektoral antar lembaga terkait. Berdasarkan Teori Perlindungan Hukum Preventif Philipus M. Hadjon dan Teori Utilitarianisme Jeremy Bentham, penelitian ini merekomendasikan reorientasi pengawasan menuju model co-regulation terintegrasi antara pemerintah dan penyedia platform digital guna menciptakan ruang siber komersial yang aman, transparan, serta berkeadilan demi kemanfaatan masyarakat luas.

The development of information technology has transformed the marketing landscape through the massive utilization of social media platforms. Behind this efficiency, the rise of digital advertising practices containing inaccurate, exaggerated, and manipulative information poses a serious threat to the rights of digital consumers. This study aims to examine the positive legal regulations in Indonesia regarding misleading advertising practices on social media and analyze the effectiveness of the monitoring system and ad content verification mechanisms in providing legal protection for consumers. The research method employed is normative legal research using a statute approach, a conceptual approach, and a case approach through the analysis of Decision Number 002/A/BPSK-DKI/VIII/2025. Sources of legal materials were collected through library research and analyzed qualitatively.The results show that existing regulations, such as Law Number 8 of 1999 concerning Consumer Protection and Law Number 1 of 2024 concerning Electronic Information and Transactions (UU ITE), have provided a normative foundation, including the opportunity for Tort/Unlawful Act lawsuits (Article 1365 of the Indonesian Civil Code) for losses incurred during the pre-contractual phase. However, a legal vacuum (rechtsvacuum) persists regarding strict parameters for contemporary promotional strategies (such as disguised endorsements and commercial disclosure obligations). Furthermore, the current supervision system is considered ineffective due to fragmented implementation and inter-agency coordination bottlenecks. Grounded in Philipus M. Hadjon’s Theory of Preventive Legal Protection and Jeremy Bentham’s Utilitarianism Theory, this study recommends a reorientation of supervision toward an integrated co-regulation model between the government and digital platform providers to establish a secure, transparent, and fair commercial cyber space for the greatest benefit of the public
