Tujuan penulisan tesis ini adalah untuk menganalisis keabsahan Sertipikat Hak Tanggungan Elektronik (HT-el) tanpa melalui proses pemeriksaan berkas pendaftaran dan penginputan passphrase Tanda Tangan Elektronik (TTE) oleh Pejabat yang berwenang, serta menganalisis tanggungjawab hukum bagi Pejabat yang berwenang yang tidak melakukan proses pemeriksaan berkas pendaftaran dan penginputan passphrase Tanda Tangan Elektronik (TTE) terhadap Sertipikat Hak Tanggungan Elektronik (HT-el). Jenis penelitian yang digunakan adalah penelitian hukum normatif yang bersifat preskriptif analitis dengan menggunakan pendekatan Perundang-Undangan (statute approach) dan pendekatan Konseptual (conceptual approach).
The purpose of writing this thesis is to analyze the validity of the Electronic Mortgage Certificate without going through the process of checking the registration file and inputting the electronic signature passphrase by the authorized official, as well as analyzing the legal responsibility for the authorized official who does not carry out the process of checking the registration file and inputting the electronic signature passphrase against the Electronic Mortgage Rights Certificate. The type of research used is normative legal research that is prescriptive analytical in nature using a statutory approach and a conceptual approach.
